MMS offers private mediations, court-ordered mediations, small claims, business to consumer mediations,  divorce, child placement/custody and relationship mediation, elder care and family mediation,  contract review & negotiations, workshop- facilitator and counselor. 

Typical Mediation Format

• Introductions – of the parties and Mediator. If applicable, identify any non-participants that may be present or impacted by the outcome of the mediation.
• Review the mediation process - Review risks to mediation - risks of impasse (explained in the 30-minute free consultation).
• Communicate the ground rules for mediation.
• Presentation of Dispute - Each party presents their view of the dispute – one party @ a time
• Identify commonalities - discuss ideas for resolution.
• Develop resolution statements 
• Post Mediation – Prepare written agreement | MOU (memorandum of understanding) and send to the parties for review. 
• Final agreement | MOU for electronic signature.

NOTE: While most mediations end with an agreement between the disputing parties – not all do! MMS cannot guarantee resolution; however, MMS will collaborate with the parties to ensure every effort is made to reach a resolution that is satisfactory to the disputing parties. MMS has the right to terminate mediation if it appears one or both party(s) is not working in good faith or there are threats to the other party or the mediator. Court ordered mediations that are terminated/cancelled by the mediator will be reported to the court with a statement of why the mediation was terminated. 

• Initial mediation consultation– Free for a 30-minute consultation. The process of mediation will be explained, as well as what to expect and what materials you will need to bring with you on the day of mediation (if applicable). 

• Hourly Fee: $250 per hour. Each party pays $125. 
• Flat Rate: $700 for 4 hours: Each party pays $350. Mediations the exceed 4 hours – the parties will each pay an additional $100/hr.

• Final Document Preparation Fee: $300– After the mediation has completed, the fee for preparing the mediated settlement agreement Memorandum of Understanding (MOU) and review is $150.00 per party for a total of $300.00. 

• Each party will receive a “draft” document of the agreed to mediated terms for final review and edits. Edits will be grammatical and spelling. Edits cannot include additions or changes to previously agreed terms/conditions. 

• MMS will send the final version to the parties to sign electronically (using DocuSign).  

Payment: MMS uses Zelle or Cash App for all payments. Payments must be made in full PRIOR to the start of mediation.

No mediation schedule is confirmed until each party has signed an agreement to mediate and has paid the non-refundable $75 (per person) fee. This fee will be applied toward the total mediation fee. The balance of the total fee is due seven (7) days ahead of the scheduled mediation.

We know “life happens” and we will collaborate with you to reschedule your session. We value your time and ours and we strive to maintain a schedule that provides sufficient time for mediations to occur and for MMS to provide a professional end product. 

If you must cancel – a cancellation fee of $200, or $100 for each party, will be charged to the canceling parties for a scheduled mediation canceled five (5) days prior to the scheduled mediation date. Mediation fees once paid are non-refundable. If the mediation is rescheduled and conducted, we will apply any funds in excess of the $200 cancellation fee (for sessions cancelled less than 5 days before scheduled date) towards the rescheduled mediation. We will make every effort to work with your schedule.
